Welcome to bluehorizon-pm.com (the “Website”), operated by Blue Horizon PM (“Blue Horizon PM,” “we,” “us,” or “our”).

These Terms & Conditions (“Terms”) govern your use of our Website and, where applicable, your purchase or use of consulting services provided by Blue Horizon PM.

 

By accessing or using this Website, you agree to these Terms. If you do not agree with these Terms, please do not use the Website.

1. Our Services

Blue Horizon PM provides consulting services primarily to owners and operators of vacation-rental properties, lake cabins, short-term rentals, vacation homes, and similar hospitality businesses. Our consulting services may include, depending on the engagement:

  • Vacation-rental business consulting

  • Property and market analysis

  • Competitive analysis

  • Rental pricing strategy

  • Revenue and occupancy analysis

  • Marketing strategy

  • Advertising recommendations

  • Guest demographic analysis

  • Online listing and positioning recommendations

  • Promotional strategy

  • Business planning

  • Property performance analysis

  • Recommendations concerning guest communications and experience

  • Other consulting services agreed upon with a client

 

Specific services, deliverables, fees, timelines, and other engagement terms may be established separately in a proposal, statement of work, consulting agreement, invoice, or other written agreement. If a separate written agreement conflicts with these Website Terms, the specific written agreement governing the consulting engagement will control with respect to that engagement.

2. No Guarantee of Results

Blue Horizon PM provides recommendations, analysis, strategies, and other consulting services based on information available to us and the circumstances existing at the time of the engagement. We do not guarantee any particular business result.

 

In particular, we do not guarantee:

  • A specific number of bookings

  • A specific occupancy rate

  • A specific revenue level

  • A specific profit level

  • Increased property value

  • Increased guest reviews or ratings

  • Increased website traffic

  • Increased advertising performance

  • Increased rental rates

  • Any particular return on investment

  • Any particular business outcome

 

Vacation-rental performance can be affected by numerous factors outside our control, including market conditions, seasonality, weather, competition, property condition, location, pricing, consumer demand, online travel platforms, economic conditions, reviews, regulations, and changes in consumer behavior. Any projections, estimates, forecasts, examples, or potential results discussed by Blue Horizon PM are informational and should not be interpreted as guarantees.

3. Client Responsibility

Clients remain responsible for their own business decisions and operations. Blue Horizon PM may provide recommendations and analysis, but the client is responsible for deciding whether and how to implement those recommendations.

 

Clients are responsible for:

  • Maintaining their properties

  • Complying with applicable laws and regulations

  • Obtaining required permits and licenses

  • Maintaining appropriate insurance

  • Paying applicable taxes

  • Complying with homeowners' association or property restrictions

  • Complying with short-term-rental regulations

  • Managing guest relationships

  • Setting final rental rates

  • Selecting booking and distribution platforms

  • Making financial and business decisions

 

Blue Horizon PM does not assume responsibility for the operation or management of a client's property unless expressly agreed to in a separate written agreement.

4. Accuracy of Client Information

Our consulting recommendations may depend on information provided by the client. Clients agree to provide information that is reasonably accurate and complete to the best of their knowledge. Blue Horizon PM is not responsible for errors, omissions, or recommendations resulting from inaccurate, incomplete, outdated, or misleading information supplied by a client or third party.

5. Market Data and Third-Party Information

Blue Horizon PM may use publicly available information, market data, industry information, online rental listings, competitive information, third-party platforms, and other sources when performing consulting services. Although we make reasonable efforts to use reliable information, we do not guarantee that third-party information is complete, accurate, current, or error-free.

Market conditions can change rapidly. Information and recommendations provided by Blue Horizon PM are based on information reasonably available at the time of analysis and may become outdated.

6. Online Rental Platforms

Blue Horizon PM may provide recommendations relating to third-party vacation-rental platforms, booking websites, advertising platforms, social-media platforms, or other online services.Blue Horizon PM does not own or control those platforms.

 

We do not guarantee:

  • Continued availability of any platform

  • Platform approval of a property or listing

  • Listing visibility

  • Search rankings

  • Booking volume

  • Platform advertising performance

  • Platform fees or policies

  • Platform algorithms

  • Platform customer-service decisions

 

Changes made by third-party platforms may affect the performance of a client's rental business.

7. Financial, Legal, Tax, and Professional Advice

Blue Horizon PM provides business consulting services. Unless expressly stated otherwise in a separate written agreement, our services do not constitute:

  • Legal advice

  • Tax advice

  • Accounting advice

  • Investment advice

  • Securities advice

  • Insurance advice

  • Real-estate brokerage services

  • Licensed property-management services

 

Clients should consult appropriately licensed professionals regarding legal, tax, accounting, insurance, investment, real-estate, or other regulated matters.

8. Website Content

The information provided on the Website is intended for general informational and educational purposes. We make reasonable efforts to provide useful and accurate information, but we do not warrant that all Website content is complete, accurate, current, or error-free. Website content should not be considered a substitute for individualized professional advice. We reserve the right to modify, update, or remove Website content at any time.

9. Intellectual Property

Unless otherwise indicated, the Website and its contents are owned by or licensed to Blue Horizon PM.

 

This includes, where applicable:

  • Text

  • Graphics

  • Logos

  • Images

  • Designs

  • Branding

  • Website layout

  • Downloadable materials

  • Consulting methodologies

  • Original educational materials

 

You may view and use Website content for personal or legitimate business purposes. You may not, without our prior written permission:

  • Copy substantial portions of the Website

  • Republish our content

  • Sell or commercially distribute our materials

  • Reproduce our proprietary consulting materials

  • Modify or create derivative works from our proprietary materials

  • Use our branding or logos in a misleading manner

10. Consulting Deliverables

Unless otherwise agreed in writing, consulting reports, analyses, recommendations, strategies, templates, presentations, and other materials created specifically for a client are provided for that client's internal business use. Clients may not resell, commercially distribute, publish, license, or otherwise provide proprietary Blue Horizon PM materials to third parties without our prior written permission. Blue Horizon PM retains ownership of its pre-existing methodologies, frameworks, templates, processes, know-how, and general consulting materials.

11. Confidentiality

Blue Horizon PM recognizes that clients may provide confidential business information during consulting engagements. We will use reasonable measures to protect confidential information and will use client information primarily for purposes of providing consulting services and operating our business. Confidential information does not include information that:

  • Is publicly available;

  • Was already lawfully known to us;

  • Becomes publicly available through no fault of ours;

  • Is independently developed without use of confidential information; or

  • Must be disclosed by law or valid legal process.

 

Additional confidentiality obligations may be established through a separate consulting agreement or confidentiality agreement.

12. User Submissions

If you submit information, comments, suggestions, testimonials, reviews, photographs, or other materials to Blue Horizon PM, you represent that you have the right to provide those materials. You should not submit confidential or proprietary information belonging to another person or business without authorization. Any use of submitted materials for marketing or promotional purposes will be subject to applicable permissions and agreements.

13. Prohibited Uses

You agree not to use the Website to:

  • Violate applicable laws or regulations

  • Attempt to gain unauthorized access to the Website or its systems

  • Introduce malicious code or software

  • Interfere with Website operations

  • Scrape or systematically collect Website content without permission

  • Impersonate another person or business

  • Submit fraudulent or misleading information

15. Payments and Fees

If you purchase consulting services from Blue Horizon PM, applicable fees, payment schedules, cancellation policies, and other commercial terms may be specified in a proposal, invoice, consulting agreement, or other written agreement. Unless otherwise agreed in writing, consulting fees are due according to the payment terms provided to the client. Failure to make required payments may result in suspension or termination of services.

16. Cancellation and Termination

Either party may terminate a consulting engagement according to the terms established in the applicable consulting agreement. Blue Horizon PM may suspend or terminate access to the Website if we reasonably believe that a user has violated these Terms or is using the Website in a manner that could harm Blue Horizon PM or others.

Termination does not eliminate obligations that by their nature should survive termination, including payment obligations, intellectual-property provisions, confidentiality obligations, disclaimers, limitations of liability, and dispute provisions.

17. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Website and its content are provided on an “as is” and “as available” basis.

 

Blue Horizon PM does not warrant that:

  • The Website will always be available;

  • The Website will be uninterrupted or error-free;

  • Website content will always be accurate or current;

  • The Website will be free from viruses or other harmful components; or

  • Consulting recommendations will produce a particular result.

 

Any warranties applicable to specific consulting services will be governed by the applicable written consulting agreement.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Blue Horizon PM and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Website or consulting services. 

 

This may include, without limitation, losses relating to:

  • Lost revenue

  • Lost profits

  • Lost bookings

  • Lost business opportunities

  • Loss of data

  • Business interruption

  • Advertising performance

  • Changes to third-party platforms

  • Changes in market conditions

 

To the fullest extent permitted by applicable law, Blue Horizon PM's aggregate liability arising from a particular consulting engagement will not exceed the amount of consulting fees actually paid to Blue Horizon PM by the client for that engagement during the 12 months preceding the event giving rise to the claim, unless a separate written agreement provides otherwise.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

19. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Blue Horizon PM and its owners, officers, employees, contractors, and agents from claims, liabilities, damages, losses, costs, and expenses arising from:

  • Your unlawful use of the Website;

  • Your violation of these Terms;

  • Information you provide that infringes another person's rights;

  • Your violation of applicable laws or regulations; or

  • Your operation or management of a vacation-rental property or business.

20. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Website or consulting services will be subject to the applicable courts located in Texas, unless otherwise required by law or agreed in writing.

21. Dispute Resolution

Before initiating formal legal proceedings, the parties agree to make a good-faith effort to resolve disputes informally.

A party seeking to resolve a dispute should provide written notice describing the nature of the dispute and the requested resolution. Nothing in this section prevents either party from seeking emergency or injunctive relief when appropriate.

If a separate consulting agreement contains dispute-resolution provisions, those provisions will govern the applicable consulting engagement.

22. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect to the extent permitted by law.

23. No Waiver

A failure by Blue Horizon PM to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.

24. Changes to These Terms

Blue Horizon PM may modify these Terms from time to time. Updated Terms will be posted on the Website with a revised Effective Date. Your continued use of the Website following the posting of revised Terms constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

25. Entire Agreement

These Terms constitute the general terms governing your use of the Website. A separate written consulting agreement, proposal, statement of work, or other agreement between Blue Horizon PM and a client may establish additional or different terms applicable to that consulting engagement. In the event of a conflict, the applicable written consulting agreement will control with respect to the consulting engagement.
